Trademark Protection in Turkish Law: An Economic Sustainability Perspective

Abstract

In contemporary market economies, value creation is increasingly driven by intangible assets. This transformation has elevated trademarks beyond their traditional function as mere distinctive signs, rendering them strategic corporate assets capable of generating measurable economic value. This article examines the regulatory framework governing trademark protection under the Turkish Industrial Property Code in conjunction with theoretical approaches developed within the law and economics doctrine. It explores how, and through which mechanisms, trademark protection is linked to economic sustainability. In this context, the study evaluates the functions of trademark protection in reducing information asymmetry, strengthening consumer trust, safeguarding reputation and distinctiveness, encouraging investment, and ensuring deterrence by diminishing the economic attractiveness of rights infringements. The principal conclusion of the study is that effective legal protection fosters market confidence and fair competition, thereby creating a structure that enhances trust in the investment environment.
